Seven Tips For When You Are Stopped During A DUI/OVI

When you are pulled over for a DUI, there are some key things that you need to keep in mind to minimize the potential charges that you may be facing. Be polite and calm when you speak to the police. Have all of your documents including your license, insurance and registration ready for the officer when they come to you. Do not answer questions about where you were or if you were drinking. You can invoke your right to an attorney.

If asked, exit your vehicle without pulling on or bracing on the door, as this can be seen as a sign of intoxication. Refuse to take any roadside tests without your attorney present. Do not consent to a search of you or your person. Lastly, if the officer has already taken you this far, they likely plan on arresting you and you need to be prepared to be taken into custody.

In August 2006, I defended a client in Hamilton County Municipal Court who was charged with assault. The accusation was that he tried to run over a family member with his car. I was able to show that the family member who made the accusation was not credible. The judge found my client not guilty at the close of the state’s case.

In February 2013, I defended a client in Hamilton County Municipal Court who was charged with DUI. My client had broadsided another car and there were empty beer cans in the back seat and beer spills on the back seats. At trial, I was able to point out that the beer spills were sticky and therefore not from that night. I was also able to point out that my client showed no coordination problems (which are key signs of impairment) during her interaction with the police officer, no slurred speech, and that she was very courteous and polite. After hearing all of the evidence, the judge found my client not guilty.

In April 2016, I defended a client in a civil protection order case in Hamilton County Common Pleas Court that involved some very horrifying allegations. My investigation of the case included a thorough examination of cellphone records, and I was able to use all of this to cast substantial doubt on the petitioner’s story. In court, I was even able to get the petitioner to make some admissions that were very helpful to my client’s case. When the petitioner’s presentation was concluded, the court ruled in favor of my client and denied the request for a civil protection order.
